[LEGAL REVIEW: this whole page]
Who sells, who licenses
- Purchases are made from Stripe as merchant of record (reseller). Stripe handles payment, tax, invoices and refunds. [Insert the exact wording required by the Stripe Managed Payments documentation verbatim]
- Your purchase contract is with Stripe under its end-customer terms. [LINK the Stripe Managed Payments customer terms]
- The software is made and licensed by Knieses (Swen Knies & Leon Knies, Bellach, Switzerland), and these terms govern your use of it.
Free use and trial
- Mink is free to use with the features of the Free plan.
- Mink opens all features for 7 days from the first time you open it on a Mac, without a key or payment. The trial ends by itself and never turns into a purchase.
Mink Unlimited
- A one-time purchase (CHF 20) grants a personal, non-transferable, non-exclusive license to use all features of Mink 1.x, including every 1.x update, on the Macs you personally use. [CONFIRM Q5: number of Macs]
- The license is perpetual. Mink confirms it with our license server from time to time (see how checks work). If we ever stop running the license server, we will first release a Mink 1.x update that unlocks Unlimited for good without any check. [Owner decision: continuity promise]
Knieses Workshop
- A subscription (CHF 3 a month or CHF 20 a year) grants the same license for every Mac app from Knieses while the subscription is active.
- It renews automatically until canceled. Cancel anytime through the Stripe customer portal (link via the License page), effective at the end of the paid period.
- After a period ends, features remain available for 7 days of grace.
- We announce Workshop price changes at least 30 days before they apply to your next renewal. You can cancel before then.
License keys
Keep your key private. Requesting a new key invalidates the old one. We may revoke keys that are refunded, charged back or clearly shared publicly.
Prices and taxes
Prices in Swiss francs, VAT included. The price shown at checkout is the price you pay. [Q3: confirm tax-inclusive prices in Stripe]
Refunds and right of withdrawal
- Refunds are handled by Stripe as the seller. If Mink isn't for you, write to us within 14 days of purchase and we'll arrange a refund. [Owner decision]
- For consumers in the EU and UK, the right of withdrawal for digital content and how it is waived at checkout follow Stripe Managed Payments' checkout terms. [LEGAL REVIEW]
- A refunded license ends and Mink returns to Free.
What never gets locked or deleted
Pairing, connecting, the cable, encryption, exporting and sharing decks, and removing devices work on every plan. Mink never deletes or rewrites your layouts because of a license.
No warranty, liability
Mink is provided as is. To the extent permitted by law, liability for slight negligence is excluded. Mandatory consumer law is unaffected. [LEGAL REVIEW]
The iPhone app
The iPhone app is free and distributed through the App Store under Apple's Standard License Agreement.
Law and venue
Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Venue: Solothurn, Switzerland, subject to mandatory consumer venues. [LEGAL REVIEW]
